Economic criteria in the current Constitution

The 103rd Constitutional Amendment inserted clauses 15(6) and 16(6). These provisions enable special measures, including reservation up to the constitutional text’s stated limit, for Economically Weaker Sections other than classes covered by the existing provisions referenced there.

In Janhit Abhiyan v. Union of India, the Supreme Court upheld the amendment by a 3–2 majority in 2022. EWS is therefore part of current law; it should not be confused with this platform’s broader proposal to move gradually toward support based on measurable need.

Why income alone does not measure opportunity

Two households reporting similar annual income may provide very different opportunities. School quality, unstable work, disability, household assets, debt, geography, parental education, family size and access to coaching can materially affect preparation.

A fair economic-support framework must also guard against under-reporting and abrupt threshold effects. Eligibility should use verifiable indicators, protect personal information and include an accessible appeal process.

What a stronger needs-based framework could measure

Household resources

Income, assets, housing conditions and financial vulnerability, assessed with clear rules.

Educational disadvantage

School infrastructure, first-generation learner status and access to preparation.

Geography and disability

Remote location, conflict or disaster exposure, and disability-related barriers.

Time and review

Updated eligibility, independent audits, appeals and published anonymized outcomes.

No index is neutral merely because it contains numbers. Indicators and weights must be publicly debated, tested against outcomes and reviewed for unintended exclusion.

Questions any proposal must answer

  • What disadvantage is the policy designed to remedy?
  • Which data can be verified without creating excessive surveillance?
  • How will regional costs and differences in school quality be handled?
  • How often will thresholds and weights be reviewed?
  • Will investment expand preparation and institutional capacity alongside selection reform?
